Employees Win as Supreme Court Refuses to Interfere with Himachal High Court Judgment against Law Curtailing Service Benefits of Contract Employees

Background:
The State of Himachal Pradesh challenged the judgment dated 25 April 2026 passed by the Himachal Pradesh High Court in CWP No. 3361 of 2025 by filing a Special Leave Petition before the Supreme Court.

Issue:
Whether the Supreme Court should interfere with the High Court’s judgment in favour of the employees/respondents. The Himachal Pradesh High Court had declared unconstitutional the State legislation enacted to deny service benefits to contract employees and to nullify the effect of earlier judicial pronouncements recognizing their rights.

Decision:
The Supreme Court dismissed the Special Leave Petition, holding that it was not inclined to interfere with the judgment of the Himachal Pradesh High Court.

Directions:
On the request of the Advocate General for Himachal Pradesh, the Court granted the State four months’ time from 29 July 2026 to comply with the High Court’s judgment, considering the nature of the request and the financial implications involved. Pending applications, if any, were also disposed of.
