Shimla | August 24, 2026:
The Himachal Pradesh High Court examined the legality of disciplinary proceedings initiated against an HRTC employee.
The petitioner was proceeded against for allegedly carrying Six ticketless passengers, resulting in an alleged revenue loss of ₹90/-. Despite the nature of the allegation, disciplinary proceedings under Rule 14 of the CCS (CCA) Rules resulted in the withholding of three annual increments with cumulative effect.
The petitioner relied upon HRTC’s Standard Operating Procedure, which provided that ticketless travel involving an amount below ₹100/- would attract a charge-sheet for a minor penalty.
During the proceedings, HRTC agreed to withdraw the impugned action. Consequently, the High Court quashed the charge-sheet and the consequential orders, while granting liberty to HRTC to proceed afresh in accordance with the applicable statutory provisions and SOP.
Significance of the Case:
Disciplinary action must remain consistent with the applicable statutory framework and departmental procedures.
